Website terms of use

1. About these terms

These terms govern your use of northstar.tel and its subdomains (the “Site”), operated by North Star Telecom, Inc. (“North Star”, “we”, “us”), 197,370 – 5222 130th Ave SE, Calgary, Alberta T2Z 0G4.

By using the Site you accept these terms. If you don’t accept them, please don’t use the Site.

These terms do not replace:

• the Master Services Agreement, which governs the services we provide. If these terms and that agreement conflict on a matter it covers, the Master Services Agreement governs;
• any signed quote, order or statement of work.

2. Who the Site is for

The Site is for businesses and organizations in Western Canada. It isn’t directed at consumers buying residential service, and it isn’t directed at children.

3. Using the Site

You may view, download and print material from the Site for your own business use in evaluating or using our services.

You may not:

• use the Site unlawfully, or in a way that damages or overloads it
• attempt to gain unauthorized access to any system, account or data
• scrape, harvest or bulk-download content, or use automated tools in a way that burdens the Site, except for search engines indexing it normally
• copy, republish or redistribute our content commercially without written permission
• remove or alter any copyright or trademark notice
• misrepresent your identity or your authority to act for an organization

We may suspend or block access to anyone who breaches these terms.

4. Our content

All content on the Site (text, images, photographs, logos, layout and software) is owned by North Star or our licensors, and protected by copyright and trademark law. Where our images come from is set out in the colophon.

“North Star Telecom”, our logo, and “Telecom That Shows Up” are our trademarks. You may not use them without our written permission.

5. What you send us

When you submit a form, send an email or send material to us:

• You confirm you may share that information, including anyone else’s personal information it contains.
• You give us permission to use it to respond to you and provide our services.
• Don’t send confidential information through the Site that you don’t want in an email system. Email isn’t secure.
• If you send us an idea or suggestion, we may use it without obligation or payment. Please don’t send confidential ideas.

Personal information is handled under our privacy policy.

6. Accuracy of information

We work to keep the Site accurate and current, but:

• Prices, specifications, availability and lead times can change without notice, and may contain errors. Nothing on the Site is a binding offer.
• The Site doesn’t sell anything. A product listing or an order request sent through the Site is not a purchase. We reply with a quote, and a quote signed by us is what binds us on price and scope.
• Technical material, comparisons and articles are general information, not advice for your particular situation.
• Any tool that recommends equipment gives a suggestion based on the answers you provide. It’s a starting point, not a design. Talk to us before ordering.

7. Availability of the Site

We aim to keep the Site available, but we don’t guarantee it will be uninterrupted or error-free. We may change, suspend or withdraw any part of it at any time. Outages affecting your phone service are handled under the Master Services Agreement, not these terms.

In an emergency, dial 911 from a working phone. Don’t use this Site to report an emergency or a service outage. Call us at (403) 698-0700.

8. Links to other sites

The Site links to sites we don’t control, and we’re not responsible for their content, products or practices. A link isn’t an endorsement.

9. Disclaimer

Except as set out in the Master Services Agreement or another signed agreement, the Site and its content are provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy or non-infringement, to the extent the law allows.

10. Limitation of liability

To the extent the law allows, North Star is not liable for indirect, incidental, special or consequential damages, or for lost profits, revenue or data, arising from your use of the Site.

Our total liability arising from the Site is limited to the amount set out below.

This section doesn’t limit our obligations under the Master Services Agreement, or exclude liability that can’t be excluded by law.

11. Indemnity

You agree to indemnify North Star against claims, losses and reasonable legal costs arising from your breach of these terms or your misuse of the Site.

12. Privacy

Our privacy policy explains how we handle personal information, including cookies and analytics. By using the Site you acknowledge that policy.

13. Governing law

These terms are governed by the laws of Alberta and the federal laws of Canada that apply there. The courts of Alberta have exclusive jurisdiction, and you consent to that jurisdiction.

14. Changes to these terms

We may update these terms. The effective date above shows when they last changed, and continuing to use the Site means you accept the updated terms.

15. General

• If any provision is unenforceable, the rest stays in effect.
• Not enforcing a provision isn’t a waiver of it.
• These terms, with the documents they reference, are the entire agreement about your use of the Site.
